Are racing liveries trademarked/copyright protected?

I recently ordered the Gulf liveried 917 t-shirt from blipshift and I was wondering if its possible to receive any backlash from using colors that are part of racing liveries. I have a few projects in mind that I'd like to work on that give homage to some classic racing colors.

Surely you can't get in trouble for recreating colors can you?

Generally, yes. as Trademarks.

but I'm pretty sure so long as you're not using it for profit you won't get in trouble.

Colours themselves are fine.. but if you're representing the livery it could get you a c&d.

So could blipshift receive backlash for having Gulf Colors on their t-shirt or if they were the same scheme but just different shades it would be okay?

Or is it something thats just so low volume no one would bother.

Because they're obviously profiting from the sales of the t-shirt thats their entire business model.

Yes, if Blipshift didn't seek permission from Gulf Oil first. Gulf Oil still actively promotes the brand and merchandise.

The trademark they have is for the specific colour combination with and without their logo. You could try and make it slightly different CMYK codes but historically the trademark will extend to any obvious attempts at replicating the colour combo.

It's likely they'd send a C&D or request their standard royalty fees.

I found their request page, so if you wanted to do a Gulf themed project they might just say yes anyway.

yeah, unless it was obvious you were imitating Gulf for commercial profit. So a Pantone Orange —PMS 165 stripe in the centre of a Pantone Blue — PMS 301 field would be enough for Gulf to claim an infringement if they were so inclined.
